1. For purposes of summary judgment only, MSI and TLC do not dispute certain of the facts Silverstein claims are undisputed. MSI reserves the right to dispute such assertions at trial. To the extent that there is a dispute germane to Silverstein's motion, MSI and TLC provide documents in support of their position.
2. Silverstein never verified that he underwent three-weeks of intensive treatment in China. MSI understands that while Silverstein may have used the three weeks to travel to Asia, he devoted little of his time there to obtaining treatment of his alleged condition. Indeed, in electronic correspondence with others, Silverstein stated that he spent only three days receiving treatment. See Exhibit H. In his deposition, Silverstein testified that he spent several days recovering from the treatment and 5-6 days sightseeing and arranging for his visa. See Silverstein Deposition, Vol. 3, pp. 72-81 (attached as Exhibit G to Silverstein's exhibit volume).
3. MSI also purchased an AB Box, a switch that enabled Silverstein to change keyboard options.
4. Silverstein's work environment was reviewed by an ergonomic consultant referred by MSI's worker's compensation carrier, and MSI abided by the consultant's recommendations. 5. In late June, 1996, Silverstein provided a doctor's note indicating that he needed to be away from the keyboard for 18 hours following acupuncture treatment. MSI abided by this restriction. However, instead of coming to work and performing non-keyboard tasks, Silverstein began to simply not report to work at all following acupuncture treatment.
