POINTS AND AUTHORITIES IN SUPPORT OF PLAINTIFF’S MOTION TO STRIKE ANSWERS OF DEFENDANT SHADE TREE SYSTEMS AND CHERRY BLOSSOM SOLUTIONS.             

 

I.      Introduction

         On September 19, 2005 Plaintiff filed a verified complaint commencing this action in this Court. On October 26th, Defendants Shade Tree Systems and Cherry Blossom Solutions (“Defendants”) removed this action to Federal Court. On October 31st, Defendants filed an unverified answer in Federal Court. The Federal Court remanded this case back to this court. On February 28, 2006, Defendants filed a another copy of the unverified answer in this Court.

 

II.     Argument

California Code of Civil Procedure § 446(a) requires a verified answer to a verified complaint. The only exception applies to a limited civil case, which this is not.

 

III.    Conclusion

         Plaintiff respectfully requests that this Court grants this motion and strikes the answer of Shade Tree Systems and Cherry Blossom Solutions.
